These Terms of Use ("Terms") govern your use of the FadeList iOS application (the "App"). The App is published by Yellow Butler LLC dba Markup Creative ("we", "us"). By downloading or using FadeList, you agree to these Terms. If you do not agree, please do not use the App.
FadeList is also distributed under Apple's standard End User License Agreement ("Apple Standard EULA"), available at apple.com/legal/internet-services/itunes/dev/stdeula. Where these Terms conflict with the Apple Standard EULA, the Apple Standard EULA controls.
Section 01License
Subject to your compliance with these Terms, we grant you a personal, limited, non-transferable, non-exclusive, revocable license to download and use FadeList on Apple-branded devices you own or control, as permitted by the Apple App Store Usage Rules.
Section 02Subscriptions and purchases
FadeList offers optional in-app purchases ("FadeList+"):
- Monthly subscription — automatically renews monthly until cancelled.
- Annual subscription — automatically renews annually until cancelled.
- Lifetime — a one-time purchase that grants ongoing access for the life of the App.
Billing
Payment is charged to your Apple ID at confirmation of purchase. Subscriptions automatically renew at the displayed price unless cancelled at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours prior to the end of the current period.
Free trials
If a free trial is offered, any unused portion of the trial is forfeited when you purchase a subscription. You may cancel during the trial to avoid being charged.
Cancelling
You can manage or cancel subscriptions at any time in your Apple ID's App Store settings. Cancelling stops future renewals; access continues through the end of the paid period.
Refunds
Refunds for App Store purchases are handled by Apple in accordance with Apple's policies. Contact Apple Support for refund requests.
Offer codes
If we provide offer codes (for example, free promotional periods), those codes are redeemed through Apple and are subject to the terms displayed at redemption.
Section 03Your content
Any tasks, lists, or other content you create in FadeList ("Your Content") belong to you. We do not access or use Your Content. Your Content is stored locally on your device and, where applicable, in your personal iCloud account. See our Privacy Policy.
Section 04Acceptable use
You agree not to:
- Reverse engineer, decompile, or attempt to extract the source code of the App, except to the extent permitted by applicable law.
- Use the App to violate any law or the rights of any third party.
- Circumvent any premium feature gating or licensing mechanism.
Section 05Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF DATA LOSS.
Section 06Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY UNDER THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE APP IN THE TWELVE MONTHS PRIOR TO THE CLAIM.
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for incidental or consequential damages — in those jurisdictions, the limitations above apply only to the extent permitted by law.
Section 07Changes to the App or Terms
We may modify or discontinue the App, or update these Terms, at any time. If we make material changes to these Terms, we will update the effective date at the top of this page. Continued use of the App after changes take effect constitutes acceptance of the updated Terms.
Section 08Termination
We may suspend or terminate your access to the App if you violate these Terms. You may stop using the App at any time.
Section 09Governing law
These Terms are governed by the laws of Oklahoma, without regard to its conflict of laws principles. Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the courts located in Oklahoma.
